Terms of Service

Notice: These Terms of Service are a binding agreement between you and the operator of SMDownloader. By visiting or using smdownloader.com — including pasting a URL and clicking Download — you agree to these Terms and our related policies. If you do not agree, do not use the service.

SMDownloader is a website, not software you install. There is no separate End User License Agreement and no browser extension or helper application is required.

SMDownloader does not host, store, archive, publish, or redistribute third-party media. The service performs temporary, user-directed processing only for the purpose of responding to the user's request.

1. Acceptance

By using SMDownloader, you agree to these Terms of Service, our Privacy Policy, Acceptable Use Policy, and Copyright Policy. These policies are incorporated by reference.

2. The service

SMDownloader is a browser-based web tool. You submit a URL from a supported platform; our servers temporarily fetch the referenced media and stream it back to you. We do not host, store, archive, publish, or redistribute third-party media. No account or login is required.

Supported platforms: Instagram, Facebook, TikTok, Threads, and YouTube (Beta). X (Twitter) is not currently supported. Support for any platform may change or be removed at any time.

3. Your responsibility

• You must own the content you submit or have permission from the rights holder to save it.
• You are solely responsible for every URL you submit and for how you use downloaded files.
• Public availability of content does not mean you have legal permission to download, copy, or reuse it.
• You may not use SMDownloader to infringe copyright, violate privacy, bypass access controls, or circumvent platform restrictions.
• You may not use automated tools, bots, or bulk scraping to abuse the service.

4. Lawful use

You may use SMDownloader only for purposes permitted by these Terms, applicable law, and the terms of any third-party platform whose content you access. You are responsible for ensuring your use complies with laws and regulations in your jurisdiction and in any jurisdiction where you access the service. We are not responsible for violations committed by you or at your direction.

5. No affiliation

SMDownloader is not affiliated with, endorsed by, or sponsored by Instagram, Meta, Facebook, TikTok, ByteDance, Threads, YouTube, Google, or any other third-party platform. See our Platform Disclaimer.

6. Prohibited conduct

You may not disrupt the service, attempt unauthorized access, distribute malware, overload our systems, or use the service in ways described in our Acceptable Use Policy. We may block specific URLs, domains, IP addresses, or entire platforms to prevent abuse, comply with law, or respond to rights-holder requests.

7. Our intellectual property

The SMDownloader website, branding, design, and underlying code are protected by intellectual property laws. These Terms do not grant you ownership of our site or technology. Third-party platform names and logos belong to their respective owners.

8. Third-party content

Media you request originates from third-party platforms. We do not control and are not responsible for that content, its availability, or platform policies. Your use of third-party content remains subject to each platform's own terms.

9. Changes, suspension, and termination

We may modify, suspend, or discontinue any part of the service at any time. We may restrict or terminate your access if you violate these Terms or if we reasonably believe your use creates legal, security, or operational risk. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive termination.

10. Disclaimer of warranties

To the fullest extent permitted by law, SMDownloader is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or compatible with every URL or device. You assume all risk from your use of the service and any files you save.

11. Limitation of liability

To the fullest extent permitted by law, the operator of SMDownloader will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising from or related to your use of the service — even if we have been advised of the possibility. Our total liability for any claim arising from these Terms or the service will not exceed one hundred U.S. dollars (US$100) or the amount you paid us in the twelve months before the claim, whichever is greater. Because the service is free, this will typically be US$100. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless the operator of SMDownloader from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the service, URLs you submit, content you download or redistribute, your violation of these Terms, or your infringement of any third-party rights.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top will change when we do. Material changes may require renewed consent before your next download. Continued use after changes take effect constitutes acceptance where permitted by law.

14. General

These Terms, together with the policies linked above, are the entire agreement between you and SMDownloader regarding the service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.
